Sereno pinasasagot sa quo warranto petition ng OSG
Binigyan ng Supreme Court si Chief Justice Maria Lourdes Sereno ng sampung araw para sagutin ang quo warranto petition na inihain ng Office of the Solicitor General.
Ang nasabing petisyon ang kumukuwestiyon sa validity ng appointment bilang chief justice.
Kahapon, naghain ng quo warranto petition ang tanggapan ni Solicitor General Jose Calida para ideklara ng Korte Suprema ang appoinment ni Sereno bilang Punong Mahistrado dahil sa hindi nito pagsusumite ng kanyang Statement of Assests Liabilities and Networth o SALN.
Iginiit ni Calida na may poder silang kuwestiyunin ang appointment ni Sereno sa ilalim ng Rule 66 ng Rules of Court lalo’t naniniwala sila na nilabag ni Sereno ang Konstitusyon dahil sa hindi pagsusumite ng kumpleto nitong SALN.
Kaugnay nito, Ibinasura ng Supreme Court en banc ang ang naunang petisyon ni Atty. Oliver Lozano na humihiling na maideklarang walang saysay ang appointment ni CJ Sereno dahil sa kawalan ng merito.
