Pagiging special prosecutor ni Duterte sa impeachment vs. Sereno, labag sa Konstitusyon – Deinla
Labag sa constitutional role ng Kongreso ang plano ni Atty. Lorenzo Gadon na hilingin sa Kongreso na gawing ‘special prosecutor’ si Pangulong Rodrigo Duterte para sa impeachment complaint laban kay Chief Justice Ma. Lourdes Sereno.
Ayon sa tagapagsalita ni Sereno na si Atty. Josalee Deinla, mandato ng Kongreso ang maging sole prosecutor para sa mga kaso ng impeachment.
Aniya, hindi pinapayagan ng Konstitusyon na maging bahagi ang pangulo sa impeachment proceedings, lalo na’t maituturing na co-equal ang mga hinahawakan posisyon ni Duterte at Sereno.
Dagdag pa ni Deinla, kagaya ng impeachment complaint ni Gadon, ang mungkahi nito ay mahinang suhesyon na nagpapakita ng kawalan niya ng kaalaman tungkol sa batas.
