Gabriela Partylist, iginiit sa Comelec na tatlong pwesto sa Kongreso ang ibigay sa kanila.
Humihirit ng ikatlong pwesto sa Kamara de Reprensentantes ang Gabriela Partylist para sa papasok na 17th Congress.
Ito ay sa pamamagitan ng motion for reconsideration at motion for correction na inihain ng grupo sa Commission on Elections o Comelec para sa karagdagan nilang representasyon.
Sa proklamasyon sa PICC nuong Biyernes, dalawang pwesto lamang ang iginawad ng Comelec na umuupo bilang National Board of Canvassers para sa Gabriela na nakakuha ng 1,367,795 votes.
Iginiit ni Atty. Alnie Foja, abugado ng Gabriela, na kung pagbabatayan ang inilatag na computation sa desisyon ng Korte Suprema sa Banat Partylist case, tatlong pwesto ang dapat na ibigay sa kanila.
Sa halip daw kasi na 59 na pwesto lamang ang ibigay sa party list representation sa Kongreso, dapat ito ay 60 na twenty percent ng 238 congressional district sa ilalim ng 17th Congress.
Dahil dito, dapat umanong madagdagan ng isa pang representasyon sa Kongreso ang Gabriela.
