Malakanyang, aminadong imposibleng maipatupad ang total ban sa endo
Aminado ang palasyo ng Malakanyang na hindi kakayin ni Pangulong Rodrigo Duterte ang hirit ng labor group na tuldukan ang endo o end of contractualization sa mga manggagawa.
Ayon kay Senior Deputy Executive Secretary Menardo Guevarra, ito ay dahil sa kinakailangan na amyendahan ng kongreso ang kasalukuyang labor code sa bansa.
“If you want something like a total ban on contractualization, you need a law to repeal or amend that particular provision of the Labor Code. An executive order is meant only to supplement, all right, or to you know give the details, implementing details of what the law provides. But it cannot add or subtract or substantially alter what the law provides. That’s really more for Congress to do. So, I hope you will understand the limitations of an executive order.” ayon kay Guevarra.
Dagdag pa niya na hindi matutuldukan ang endo sa pamamagitan lamang ng isang executive order.
Inamin ni Guevarra na sakaling magpalabas si Pangulong Duterte ng bagong EO sa endo, hindi ito malalayo sa naunang inilabas na department order ng Department of Labor and Employment na nanawagan sa mga employer na magpatupad ng mas mahuigpit na regulation sa kontraktuwal na mga manggagawa.
Sakali aniyang hindi natuwa ang labor group sa EO na ilalabas ni Duterte, saka lamang kikilos ang hekutibo at lalapit sa kongreso na amyendahan ang labor code ukol sa kontraktuwalisasyon.
